Welcome to Trustume by EPSoft ("Trustume," "we," "our," or "us"). These Terms of Service ("Terms") govern your use of our website at https://trustume.com and all associated services, features, and functions offered through the Trustume platform (collectively, the "Service").
By creating an account, accessing our website, using our platform, submitting a form (including Sign Up, Contact Us, or Get a Demo), or otherwise using Trustume, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
We recommend that you read these Terms carefully in conjunction with our Privacy Policy and Cookie Policy, which are incorporated by reference into this agreement.
2. Eligibility and Registration
2.1 Age and Capacity
You represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this agreement. Our Service is not intended for children under the age of 13. By using Trustume, you confirm that you are not a minor or that you have obtained parental consent if required by applicable law.
2.2 Account Registration
To create an account or use certain features of Trustume, you must provide accurate, truthful, and complete information. You agree to keep your account information updated and to notify us immediately of any unauthorized use of your account or any breach of security.
You are responsible for maintaining the confidentiality of your login credentials and password. You agree not to share your account with others or allow unauthorized third parties to access your account.
2.3 One Account Per Person
You may not create multiple accounts or use fake information to create accounts. Trustume reserves the right to terminate or suspend any account created in violation of this provision.
3. Description of Service
Trustume is a professional employment and recruitment platform that enables job seekers and employers to connect, manage profiles, and facilitate hiring and employment processes.
4. Employment Verification
4.1 Verification Process
Trustume may facilitate employment verification as part of its core service offering. Employment verification is used to validate employment history, qualifications, and background information provided by users (typically job seekers).
4.2 How Verification Works
When you provide employment information on Trustume, including the names and contact information of previous employers or professional references, we may:
Send automated verification requests to the references you provide.
Contact previous employers or references directly to validate employment dates, job titles, responsibilities, and other relevant details.
Collect verification information directly from third-party sources to confirm the accuracy of your employment history.
4.3 Consent for Verification
By creating an account and providing employment information on Trustume, you explicitly consent to:
The use of your employment history and related details for verification purposes.
Our contact of your previous employers, supervisors, or professional references to verify employment information.
The collection and processing of verification responses from those third parties.
The use of verification data to maintain the integrity and credibility of the Trustume platform.
You further consent to Trustume sharing your name, contact information, and employment history with employers, recruiters, and verified professional contacts on the platform, in accordance with your profile privacy settings.
4.4 Third-Party Verification Data
Verification information we receive from third-party sources (such as employer confirmations or reference responses) is treated as information collected from a different source than your direct input.
This data becomes part of your profile record and may be used to validate your employment claims, update your profile accuracy status, and support your profile visibility on the platform.
We maintain records of verification responses and may update your profile to reflect the verification outcome (e.g., "Employment Verified," "Pending Verification," or "Unable to Verify").
4.5 Verification Accuracy and Disputes
You are responsible for ensuring that the employment information you provide is accurate and complete.
If verification reveals discrepancies, between the information you provided and third-party records, Trustume may flag your profile or take action to protect the integrity of the platform.
If you believe verification information is inaccurate, you may contact hello@trustume.com to dispute the result. We may re-verify or update your profile accordingly.
4.6 Legal Basis for Verification
Employment verification is conducted in accordance with applicable employment and data protection laws in the United States and India, including the Digital Personal Data Protection Act, 2023 (India), and relevant US state privacy laws.
5. User Obligations and Prohibited Activities
5.1 Acceptable Use
You agree to use Trustume only for lawful purposes and in compliance with these Terms. You agree not to:
Provide false, misleading, or fraudulent information in your profile, employment history, qualifications, or any form submission.
Impersonate another person or misrepresent your identity, employment history, or professional qualifications.
Harass, threaten, defame, or abuse other users or Trustume staff.
Upload malware, viruses, or any code designed to harm or compromise the Service.
Attempt to gain unauthorized access to Trustume systems, databases, or accounts.
Scrape, crawl, or extract data from the Service without authorization.
Use the Service to facilitate fraud, identity theft, discrimination, or illegal employment practices.
Violate any applicable employment, labor, or data protection laws.
Use the Service in any manner that could damage, overload, or impair the platform.
5.2 Profile Accuracy and Misrepresentation
You are solely responsible for the accuracy of your profile information. Deliberately providing false employment history, credentials, or professional qualifications may result in immediate account suspension or termination. Misrepresentation of employment history or professional qualifications may also constitute fraud under applicable law and could expose you to legal liability.
6. Intellectual Property Rights
6.1 Trustume's Intellectual Property
All content, design, functionality, source code, and materials on the Trustume platform, including but not limited to text, graphics, logos, icons, images, software, and documentation, are owned by Trustume or its licensors and are protected by copyright, trademark, and other intellectual property laws.
6.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to access and use the Trustume Service for your personal, non-commercial employment-related purposes. You may not reproduce, modify, distribute, or commercially exploit any part of Trustume without our prior written consent.
6.3 User-Generated Content
Any information, profile content, resume, documents, or other materials you upload to Trustume ("User Content") remain your property. By uploading User Content to Trustume, you grant us a worldwide, royalty-free, non-exclusive license to use, store, display, and share your User Content as necessary to operate the Service and facilitate employment connections.
You represent and warrant that you own or have the necessary rights to all User Content you provide and that your User Content does not infringe on any third-party intellectual property rights.
7. Data Handling and Storage
7.1 Data Storage and Processing
Your personal data and profile information are stored on Google Cloud Platform (GCP) and processed in accordance with our Privacy Policy and applicable data protection laws. By using Trustume, you consent to the storage, processing, and potential transfer of your data through our cloud infrastructure and third-party service providers.
7.2 Data Security
We implement reasonable technical and organizational security measures to protect your data, including encryption for data in transit and at rest using TLS 1.3 protocols. However, no security measure is completely foolproof, and we cannot guarantee absolute security of your data.
7.3 Backup and Recovery
While we maintain regular backups of user data to ensure service continuity, we are not obligated to recover deleted data or restore previous versions of your profile after permanent deletion.
8. User Rights and Account Management
8.1 Profile Editing
You may edit your profile information except the associated email ID at any time by logging into your Trustume account and navigating to the profile settings page. You have the right to update your name, employment history, references, and other profile details directly through the platform interface. At this point, we don't provide the ability to change associated email ID to your profile in any manner.
8.2 Data Access and Portability
You have the right to request access to your personal data stored by Trustume. You may exercise this right through your account dashboard or by contacting us at hello@trustume.com. We will provide you with your data in a portable format within a reasonable timeframe.
8.3 Account Suspension or Termination
Trustume reserves the right to suspend or terminate your account if you:
Violate these Terms of Service.
Provide false or fraudulent information.
Engage in harassment, abuse, or illegal activity.
Violate applicable employment or data protection laws.
Use the Service in any manner that harms the platform or other users.
Account suspension or termination will be communicated to you via email when possible. In cases of severe violations or illegal activity, termination may be immediate and without prior notice.
8.4 Account Deletion
You may request account deletion at any time by contacting hello@trustume.com or through your account settings. Upon your request, we will permanently delete all personal data associated with your account within 72 hours. This includes your profile information, employment history, uploaded documents, references, and all associated activity logs.
This deletion is permanent and irreversible. We do not retain copies of your data after deletion except as required by law or to comply with legal obligations.
9. Limitations of Liability
9.1 Disclaimer of Warranties
Trustume is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
9.2 Limitation of Liability
To the maximum extent permitted by law, Trustume and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to loss of data, loss of income, or business interruption.
9.3 Your Remedy
Your sole and exclusive remedy for any dispute with Trustume is the termination of your account and cessation of use of the Service.
10. Indemnification
You agree to indemnify, defend, and hold harmless Trustume and its officers, directors, employees, and agents from any and all claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
Your use of the Service.
Your violation of these Terms.
Your violation of applicable laws.
Your User Content or profile information.
Your employment history misrepresentation or fraudulent claims.
Any harm you cause to other users or third parties through your use of Trustume.
11. Dispute Resolution and Governing Law
11.1 Arbitration
Any dispute arising out of or relating to these Terms or your use of Trustume shall be resolved through binding arbitration administered by [Arbitration Body - e.g., JAMS or ICC], rather than in court. The arbitration shall be conducted in English and governed by the rules applicable in your jurisdiction.
11.2 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where you reside (United States or India, as applicable), without regard to conflict-of-law principles.
11.3 Venue and Jurisdiction
If arbitration is not enforceable for any reason, you agree to submit to the exclusive jurisdiction of the courts located in your jurisdiction of residence.
12. Modifications to Terms
Trustume reserves the right to modify these Terms at any time. We will notify you of significant changes via email or through an in-app notification. Your continued use of the Service after the effective date of modified Terms constitutes your acceptance of the new Terms.
If you do not agree with the modified Terms, you must discontinue use of the Service and delete your account.
13. Termination of Service
Trustume reserves the right to discontinue or modify the Service, or any part thereof, at any time without liability to you or any other party. We will provide reasonable notice of significant service changes or discontinuation where practicable.
14. Miscellaneous Provisions
14.1 Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Trustume regarding your use of the Service and supersede any prior agreements or understandings.
14.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
14.3 Waiver
Trustume's failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
14.4 Assignment
You may not assign your rights or obligations under these Terms without Trustume's prior written consent. Trustume may assign its rights and obligations at any time without notice.
